The Davis, Saunders, Miller & Oden Law Firm concentrates on serious personal injury and wrongful death litigation in State and Federal Courts throughout the United States. The fields of practice in which the firm concentrates include representing railroad workers injured on-the-job who are covered by Federal Employers' Liability Act (FELA), seamen and offshore workers hurt at sea whose legal rights are governed by Maritime Law (Jones Act), and cases arising from commercial and private airplane crashes, including litigation for pilot error, and cases against the Federal Government for air traffic controller negligence under the Federal Tort Claims Act (FTCA). The firm also handles Railroad Whistleblower retaliation claims under the Federal Railroad Safety Act (FRSA). The railroad whistleblower statute was enacted in 2007 to prohibit railroads from retaliating against railroaders who report on-duty injuries or safety hazards. The firm has tried and resolved cases before juries in New Orleans, Louisiana, and in Courts from Houston, Texas to as far north as Washington, D.C., and as far south as West Palm Beach, Florida. The firm has obtained favorable jury verdicts in Louisiana, Mississippi, Alabama, Georgia, Florida, South Carolina, North Carolina, Texas and Virginia. Both Ben B. Saunders and Joseph Miller published articles in the Loyola Law Review where they each served as Managing Editor during their legal education at Loyola Law School in New Orleans, Louisiana. Today, Ben B. Saunders serves on the Loyola Law Alumni Board of Directors and teaches Railroad Law at AAJ Railroad Law section meetings. Moreover, Joseph Miller has had his article on Railroad Law Preclusion cited by courts nationally. Carisa German-Oden tried the first successful case under the new FRSA law to return an injured railroad engineer to service after the railroad carrier denied her a return to work physical. This is the first case in the country where this law was used as a sword, preventing the railroad from unilaterally and illegally picking and choosing which employees would be allowed to return to work. Ben B. Saunders is now Designated Legal Counsel for the SMART TD (formerly the United Transportation Union). Ben B. Saunders and Joseph Miller have been recognized in The Best Lawyers in America and Super Lawyers. In addition, Ben B. Saunders has been listed in the Top 100 Trial Lawyers by the American Trial Lawyers Association. Joseph Miller was recently listed in the 2015-2016 Super Lawyers Rising Star List in Louisiana. In 2015, Joseph Miller was listed as that year's Best Lawyers New Orleans Railroad Law "Lawyer of the Year."
