The firm's founders were Sam Daniels and Mark Hicks. Prior to practicing in Florida, Sam Daniels served as a law clerk to U.S. Supreme Court Associate Justice Hugo L. Black. In the commemorative book written about the first 50 years of the Third District Court of Appeal of Florida, the authors state that Chief Judge Alan Schwartz credited Sam Daniels as "?'inventing' the specialty of appellate practice." In writing about the appellate practitioners appearing before the Third District, the authors state:

The firm was founded as Daniels and Hicks, P.A. in 1978 and later became known as Hicks, Porter, Ebenfeld & Stein, P.A.
