Whether the case can be won is an important question, but not the only question. How long it might take, how much it might cost and what are the alternatives are all issues to be considered in a sensible and reasoned approach to litigation.

The lessons learned in conflict resolution have their applicability in transactional work as well. Closing the deal is important, but closing the deal with no residual exposure to the client is most important. In our litigation and transactional work, prudence and common sense are our touchstones.
