Abigail Pessen is a mediator and arbitrator of business and employment disputes. Before starting her dispute resolution firm in 2000, she was a litigator at the law firm of Seiff Kretz & Maffeo (formerly Scoppetta & Seiff), handling business, employment, and family matters as an associate and then partner for more than twenty years. Abigail has been honored by New York City Best Lawyers as Lawyer of the Year for 2019 in the field of arbitration; she was chosen Lawyer of the Year for 2015 in the field of mediation. Abigail is one of only four New York City firms to have received U.S. News and World Report's highest Tier One ranking for both mediation and arbitration. She is consistently selected as a "Super Lawyer" in the field of dispute resolution and included in New York Magazine's Best Lawyers in the New York Metropolitan Area for dispute resolution.
Abigail is thrilled to have been selected for the American Arbitration Association's new Master Mediation Panel - - composed of just nine mediators - - for complex commercial cases. She has successfully mediated hundreds of substantial disputes privately and for the American Arbitration Association's Commercial, Large Complex Case, and Employment Panels, the International Center for Dispute Resolution, the Equal Employment Opportunity Commission, the United States District Court for the Eastern District of New York, and the New York County Supreme Court Commercial Division.
Abigail has served as sole arbitrator, panel chair, and panel member for the American Arbitration Association's Large, Complex Case Panel, Employment Panel, and the International Center for Dispute Resolution, in numerous business and employment cases involving breach of contract, licensing, executive compensation, franchise agreements, trademark, distributorship, partnership, insurance, restrictive covenant, discrimination, employment, FLSA, misclassification, and securities issues.
Abigail is a past Chair of the New York State Bar Dispute Resolution Section. She has been a faculty member at Cardozo Law School and a presenter for the American Arbitration Association, the NY State Bar Dispute Resolution Section,the Practicing Law Institute, the ABA, New York State and New York City Bar Associations' "Bridge the Gap" programs, and a trainer for mediation programs sponsored by the Office of Court Administration.
Abigail is the author of a chapter on confirming and vacating arbitration awards in a PLI Treatise on Arbitration published in 2019; Employment Mediation: Key Issues and Considerations, published by Practical Law Institute in 2014; The Bespoke Clause: Tailoring Federal Rule 68 to Arbitration, NY Dispute Resolution Lawyer, Fall 2013; Alternative Dispute Resolution Law, a comprehensive survey chapter for DEVELOPMENTS IN BUSINESS AND CORPORATE LITIGATION, published annually by the ABA in 2001, 2002, 2003, and 2004, as well as numerous articles on dispute resolution topics. She has served as chair and lectured at numerous CLE programs, ADR training programs, and forums at the American Bar Association, the New York State Bar Association, the New York City Bar Association, the American Arbitration Association, and various law schools.
Abigail clerked for United States District Judge Whitman Knapp in the Southern District of New York, and was an assistant professor at New York Law School. She graduated from Barnard College and received her law degree from the University of Chicago. She is a Fellow of the College of Commercial Arbitrators and of the American Bar Foundation. Abigail has been awarded an "AV Preeminent" rating from Martindale-Hubbell.
