What is a misdemeanor?
Minor Misdemeanor
Examples of crimes usually charged as minor misdemeanors in Ohio include: marijuana possession (under 100g) and certain traffic violations (e.g. speeding or failure to maintain control). The maximum penalty for a minor misdemeanor is a $150 fine.
There may be other penalties imposed as well depending on the charge, such as points on your license (for speeding or traffic offenses) or license suspensions (for minor misdemeanor marijuana possession or paraphernalia).
Fourth Degree Misdemeanor
Examples of crimes usually charged as fourth degree misdemeanors include: criminal trespass, domestic violence, hazing, marijuana possession (between 100g - 200g) and menacing. The maximum penalty for a fourth degree misdemeanor is 30 days in jail and a $250 fine.
Third Degree Misdemeanor
Examples of crimes usually charged as third degree misdemeanors include: criminal mischief and unauthorized use of property (valued under $1000). The maximum penalty for a third degree misdemeanor is 60 days in jail and a $500 fine.
Second Degree Misdemeanor
Examples of crimes usually charged as second degree misdemeanors include: criminal damaging or endangering, obstruction of official business and resisting arrest. The maximum penalty for a second degree misdemeanor is 90 days in jail and a $750 fine.
First Degree Misdemeanor
