Civil Litigation
Civil litigation refers to the area of legal practice that involves a lawsuit in civil court between at least two parties, in which one party is generally seeking a monetary reward. Civil litigation can be resolved through settlement, mediation, arbitration or a trial. The areas of law outlined below are those areas of civil litigation in which we have expertise.

Employment Law
In representing business clients, one of our most important roles is in advising our clients as to the best methods to avoid problems that can result in time consuming and expensive litigation. We keep apprised of the rapid developments that occur in Montana employment law in a variety of areas (including discrimination, wrongful discharge, covenants not to compete, breach of loyalty, and others). We aggressively represent our clients when litigation cannot be avoided.

Insurance Law
In addition to defending individuals when hired by their insurer, we have developed expertise providing opinions regarding insurance coverage and insurance bad faith. We have used this expertise to provide opinions to help avoid litigation for insurers, and in defending insurers against claims of bad faith in handling insurance claims.

Mediation
We enjoy assisting attorneys and their clients in resolving disputes in a non-adversarial manner while serving as neutral facilitators. These confidential proceedings may occur before or during litigation.

Medical Malpractice (Defense Only)
We have extensive experience in defending physicians, hospitals, nursing homes, mid-levels, dentists and therapists from claims of professional negligence. We also enjoy assisting licensees in matters before various licensing boards.

Personal Injury
Throughout our careers, we have experience both defending against claims of personal injury in a variety of circumstances, and representing individuals who have received injuries as the result of another's wrongdoing. In our 30 years of combined practice, we have handled almost every conceivable personal injury claim.
