Job Overview:

A law firm seeks a seasoned Healthcare Litigation Attorney to join its established healthcare practice group. This role is designed for an attorney with significant experience in healthcare law, commercial litigation, and white-collar defense. The attorney will represent medical professionals in professional liability, medical malpractice, and employment-related cases. Ideal candidates will have a deep understanding of healthcare regulations and a track record of litigation success. Duties:

  • Manage healthcare litigation cases from initiation through resolution, including medical malpractice and professional liability suits.
  • Draft and review legal documents such as pleadings, motions, and briefs.
  • Represent clients in court, arbitration, and other legal proceedings.
  • Provide clients with legal advice regarding healthcare regulations and their rights.
  • Conduct thorough legal research and analysis of healthcare-related laws and regulations.
  • Develop and implement legal strategies tailored to individual cases.
  • Stay informed on evolving healthcare regulations, including HIPAA, Anti-Kickback statutes, False Claims Act, Medicare/Medicaid, and managed care issues.
  • Collaborate with junior attorneys, reviewing regulatory analyses and offering mentorship.
  • Offer legal support to other practice areas such as Employment Law and Financial Services.
  • Identify potential legal risks and compliance issues, providing effective legal solutions.
  • Take a lead role in healthcare-related legal matters and collaborate with the firm’s other business units when necessary.

Requirements:

  • Minimum of 7 years of legal experience, with a primary focus on healthcare law and litigation.
  • Demonstrated knowledge of healthcare regulations, including Medicare/Medicaid fraud, telemedicine, HIPAA, and other relevant statutes.
  • Strong litigation background, including experience representing healthcare professionals or organizations.
  • Prior experience as a healthcare prosecutor, such as a former Deputy Attorney General or Assistant U.S. Attorney, is highly desirable.
  • Experience with hospital systems, health systems, 340B programs, or pharmacies is preferred.
  • A proactive and detail-oriented approach to handling complex legal cases.

Education:

  • Juris Doctor (JD) from an accredited law school.

Certifications:

  • Admitted to the New Jersey Bar (NY admission is preferred or must be obtained).

Skills:

  • Deep knowledge of healthcare law, including HIPAA, Anti-Kickback statutes, False Claims Act, and other relevant healthcare regulations.
  • Strong legal research and drafting skills, with the ability to synthesize complex information into actionable legal strategies.
  • Exceptional communication and negotiation abilities, with experience presenting legal arguments in court.
  • Ability to collaborate with a team while also working independently to manage cases and responsibilities.
