A law firm in Buffalo, NY, is seeking a Mid-Senior Level Patent Litigation Associate Attorney to join their team. The role requires a proactive and skilled attorney to work closely with clients, helping them navigate complex patent issues, adapt to evolving legal landscapes, and protect their intellectual property. The ideal candidate will bring extensive experience in patent litigation, strong technical knowledge, and a commitment to high-quality client service.

Duties:

  • Collaborate with clients to address and overcome patent-related obstacles, ensuring they remain compliant with evolving patent laws and judicial decisions.
  • Develop and implement strategies to maneuver around competitors' patents and maximize the value of clients' intellectual property.
  • Draft and file pleadings, motions, memoranda, and correspondence for use in state and federal court proceedings, as well as arbitration and mediation.
  • Manage complex discovery processes, including drafting and responding to detailed discovery requests.
  • Engage in negotiations and communication with opposing counsel to advance client interests.
  • Prepare for and conduct depositions, including overseeing witness preparation and managing deposition logistics.
  • Prepare for trial, including creating exhibit lists, formulating evidentiary objections, drafting motions in limine, and managing witness preparation.
  • Draft and file Federal Circuit appeal briefs and support appellate litigation as necessary.
  • Supervise and mentor junior associates, providing guidance on case management and professional development.

Requirements:

  • 6-8 years of patent litigation experience, with substantial experience in drafting and responding to pleadings, preparing infringement and invalidity claim charts, handling Markman and claim construction proceedings, and managing patent-specific fact and expert discovery.
  • Experience with inter partes reviews and overall litigation strategy.
  • Strong academic credentials and excellent judgment.
  • Patent trial experience is a plus.
  • USPTO admission and an undergraduate degree in Electrical Engineering, Computer Science, or substantial experience in litigating matters in these or similar technical disciplines are highly desired.

Education:

  • Juris Doctor (JD) from an accredited law school.
  • Undergraduate degree in Electrical Engineering, Computer Science, or a related technical field is preferred.

Certifications:

  • Admission to the USPTO is highly desired.

Skills:

  • Expertise in patent litigation, including managing complex cases and drafting detailed legal documents.
  • Proficiency in preparing and responding to discovery requests, conducting depositions, and trial preparation.
  • Strong negotiation, client communication, and strategic thinking abilities.
  • Ability to supervise and mentor junior associates effectively.
  • Familiarity with Federal Circuit appeal processes and appellate litigation.
