ERISA - Employee Benefits Attorney

Job Overview:
A prestigious law firm located in Minneapolis, MN is looking to hire an experienced Employee Benefits / ERISA Attorney to provide legal counsel and support to a wide variety of clients. The successful candidate will advise on and manage various employee benefit plans, including retirement plans, health and welfare plans, and multiemployer pension plans. This role offers an opportunity to collaborate with other practice groups and play an essential part in the firm's growth and client success.

Duties:

  • Provide legal guidance on retirement plans, such as traditional defined benefit pensions, 401(k), 403(b), profit-sharing plans, and employee stock ownership plans (ESOPs).
  • Advise on health and welfare plans, including medical and welfare plans, retiree health funding, health reimbursement arrangements, and cafeteria plans.
  • Represent multiemployer pension plans, plan fiduciaries, contributing employers, and employer associations in areas like collective bargaining, funding, governance, and fiduciary responsibilities.
  • Address compliance matters related to IRS, PBGC, HHS, and DOL regulations, including HIPAA, fiduciary issues, withdrawal liability, mergers and acquisitions, plan document drafting, and contract negotiations.
  • Handle ERISA-related litigation, including withdrawal liability disputes, delinquent fringe benefit contributions, benefit denial claims, and fiduciary duty disputes.
  • Collaborate with other legal teams, including labor and employment, litigation, and corporate groups.

Requirements:

  • Juris Doctor (JD) from an ABA-accredited law school.
  • Licensed to practice law in the State of Minnesota or the ability to become licensed in Minnesota within 3 months of hire.
  • 5 years of experience in ERISA and employee benefits law.

Education:

  • JD from an ABA-accredited law school.

Certifications:

  • Admission to the State Bar of Minnesota or eligibility to become licensed.

Skills:

  • Strong understanding of ERISA and employee benefits law.
  • Excellent research, analytical, and legal writing abilities.
  • Ability to provide strategic legal advice on complex benefit plans.
  • Effective communication skills and client relationship management.
  • Ability to work collaboratively with various legal teams.
