Mid-Senior Level Patent Litigation Associate Attorney

Job Overview:

A law firm is seeking a highly skilled and experienced mid-Senior-Level Patent Litigation Associate Attorney to join its team in New York City, NY. The ideal candidate will have a strong patent litigation background, with substantial experience handling complex cases and providing strategic legal advice. Duties and Responsibilities:

• Draft pleadings, motions, memoranda, and correspondence for state and federal court, arbitration, and mediation proceedings.
• Draft and respond to complex discovery requests, ensuring thorough and strategic handling of all aspects of discovery.
• Confer, negotiate, and communicate effectively with opposing counsel to resolve disputes and advance client interests.
• Prepare for, defend, and conduct depositions, including witness examination and preparation.
• Prepare for trial by developing exhibit lists, drafting evidentiary objections and motions in limine, and conducting witness preparation.
• Draft Federal Circuit appeal briefs, ensuring rigorous legal analysis and clear, persuasive writing.
• Supervise and train junior associates, providing guidance and mentorship to develop their litigation skills.
• Participate in Markman and claim construction proceedings, focusing on detailed legal and technical analysis.
• Prepare infringement and invalidity claim charts and manage patient-specific facts and expert discovery.
• Engage in inter-part reviews and contribute to overall litigation strategy.
• Collaborate with a team of attorneys to develop and execute litigation strategies that align with client goals.

Requirements:

• 6-8 years of patent litigation experience, with significant experience in drafting and responding to pleadings, motions, and discovery requests.
• Extensive experience preparing infringement and invalidity claim charts, conducting Markman and claim construction proceedings, and managing patent-specific facts and expert discovery.
• Experience with inter partes reviews and overall litigation strategy is required.
• Patent trial experience is a plus.

Education and Certifications:

• Juris Doctor (JD) degree from an accredited law school.
• Admission to the New York State Bar is required.
• Admission to practice before the United States Patent and Trademark Office (USPTO) is highly desired.
• An undergraduate degree in Electrical Engineering or Computer Science or substantial experience litigating matters in these or similar disciplines is highly preferred.
