A well-regarded legal practice is seeking a highly skilled ERISA Litigation Attorney to take a lead role in complex litigation matters, with a focus on class actions. This position offers a unique opportunity for a seasoned attorney passionate about advocating for employees and ensuring compliance with fiduciary responsibilities. The ideal candidate will be deeply familiar with ERISA’s fiduciary duty provisions and possess substantial experience in federal court litigation. With a collaborative team environment and a hybrid work model available, this role provides flexibility while maintaining meaningful engagement in high-stakes litigation.
Key Responsibilities:
Conduct in-depth investigations and develop class action claims related to ERISA violations.
Prepare, file, and persuasively argue motions, including those related to class certification.
Oversee and execute discovery strategies, including taking and defending depositions of plan fiduciaries, administrators, and other key individuals.
Engage with expert witnesses, particularly in actuarial and financial disciplines, to build strong evidentiary support for cases.
Manage and participate in settlement negotiations and mediation efforts to secure favorable resolutions.
Maintain productive communication and collaboration with co-counsel and opposing counsel throughout litigation.
Advocate for clients in federal court proceedings, including trials and, where applicable, state-level litigation.
Handle appellate matters, ensuring continued representation and advocacy in higher courts.
Required Qualifications:
Juris Doctor (J.D.) degree from an accredited law school.
Active membership in the California State Bar.
Five or more years of ERISA litigation experience, with a demonstrated ability to handle class action lawsuits.
Comprehensive knowledge of ERISA’s fiduciary duty and prohibited transaction provisions.
Proficiency in legal research, persuasive writing, and oral advocacy.
Experience managing federal litigation, including handling appeals and procedural complexities.
Demonstrated skill in conducting depositions and navigating discovery disputes.
Strong communication abilities, with the capacity to clearly articulate complex legal concepts to clients and colleagues.
A commitment to protecting employees’ rights and promoting fair treatment under ERISA laws.
