Job Overview:

A law firm in New York City, NY, is seeking a Senior Advertising Marketing and Promotions Associate Attorney with at least 7 years of relevant experience. This position involves handling various legal issues related to advertising, marketing, and promotions, including compliance and transactional work. The ideal candidate will bring substantive expertise in advertising law, consumer protection, and marketing transactions and will be skilled in navigating complex legal challenges in these areas.

Duties:

• Draft and negotiate various marketing and promotion agreements, including ad agency contracts, influencer and celebrity endorsement deals, sponsorship agreements, and online media buying contracts.
• Review and analyze advertising copy to ensure compliance with laws concerning false advertising, claim substantiation, intellectual property (IP) rights, and right of publicity.
• Provide counsel on regulatory issues related to contest and sweepstakes compliance.
• Advise clients on price advertising strategies and recurring subscription programs.
• Offer guidance on loyalty and rewards programs, ensuring they meet legal standards.
• Manage and resolve disputes involving false advertising, unfair competition, and National Advertising Division (NAD) challenges.
• Collaborate effectively with team members and clients to address complex legal issues.
• Maintain high attention to detail in all aspects of work.

Requirements:

• Minimum of 7 years of relevant experience in advertising law, consumer protection law, and marketing transactions.
• Proven experience in drafting and negotiating marketing-related agreements.
• Strong background in reviewing advertising content for compliance with legal standards.
• Familiarity with contest and sweepstakes regulations, price advertising, subscription, and loyalty/rewards programs.
• Experience with false advertising and unfair competition cases, including NAD disputes, is highly desirable.
• Ability to work well both independently and as part of a team.
• Excellent academic credentials.

Education:

• Juris Doctor (JD) degree from an accredited law school.

Certifications:

• Licensed to practice law in New York.
