Senior Associate Attorney

A law firm in Miami specializing in intellectual property seeks a Senior Associate Attorney with extensive experience in trademark law. The ideal candidate will handle all aspects of domestic and global trademark prosecution, strategy, enforcement, and management. This role requires strong skills in trademark counseling, clearance search and analysis, prosecution and maintenance, portfolio management, and resolution of trademark disputes.

Duties and Responsibilities:

• Manage trademark portfolios, including conducting clearance searches, drafting opinions, and advising clients on trademark availability and registration strategies.
• Draft and prosecute trademark applications before the USPTO and coordinate with foreign associates for international filings.
• Counsel clients on trademark enforcement strategies, including cease-and-desist letters, domain name disputes, and online enforcement actions.
• Negotiate and draft agreements related to trademarks, including licenses, assignments, coexistence agreements, and settlement agreements.
• Conduct intellectual property due diligence in corporate transactions and assist in IP aspects of mergers, acquisitions, and licensing deals.
• Handle trademark disputes before the Trademark Trial and Appeal Board (TTAB), including drafting pleadings, discovery requests, and motions.
• Provide strategic advice on trademark litigation matters and manage litigation discovery processes.
• Stay updated on developments in trademark law and provide training and guidance to junior associates and legal staff.

Requirements:

• Juris Doctor (JD) degree from an accredited law school.
• Admission to the Bar in good standing in the state of Florida.
• 6+ years of experience practicing trademark law, preferably at a reputable law firm.
• Proven track record in managing complex trademark portfolios and handling trademark disputes.
• Strong understanding of trademark prosecution procedures and international trademark laws.
• Experience in negotiating and drafting IP-related agreements.
• Exceptional research, writing, and communication skills.
• Ability to work independently and collaboratively in a fast-paced environment.

Preferred Skills:

• Experience with IP due diligence in corporate transactions.
• Familiarity with trademark litigation procedures and TTAB proceedings.
• Fluency in Spanish or other languages is a plus.

Certifications:

• Certification in Intellectual Property Law by the Florida Bar (preferred but not required).
