This role involves representing clients in bankruptcy proceedings, protecting creditor rights, and providing expert legal counsel. The successful candidate will work closely with a team of legal professionals and named partners, managing a diverse caseload and engaging in various bankruptcy-related legal activities.

Duties and Responsibilities:

  • Represent creditors in bankruptcy cases, including filing proofs of claim, attending creditor meetings, and advocating for clients' interests.
  • Conduct legal research and analysis to provide sound legal advice to clients and colleagues.
  • Advise clients on bankruptcy-related matters, including debt collection, asset recovery, and creditor rights.
  • Draft and review legal documents, including pleadings, motions, and agreements.
  • Engage in negotiations with opposing counsel, debtors, and bankruptcy trustees to achieve favorable settlements.
  • Appear in court on behalf of clients, representing them in hearings, trials, and other legal proceedings.
  • Effectively manage a caseload and ensure compliance with deadlines and court requirements.
  • Handle out-of-court debt restructuring and workouts.
  • Seek receiverships over commercial real estate and businesses.
  • Address issues related to problem real estate, asset-based commercial loans, and leases.
  • Negotiate and object to confirmation plans.
  • Represent or participate in creditor committees.
  • Address issues involving unexpired leases and other executory contracts.
  • Request modifications of stays.
  • Defend mortgage lenders, including both first and second position liens.
  • Handle fraudulent conveyance and preferential litigation matters.

Requirements:

  • 5+ years of experience in bankruptcy and creditor's rights law.
  • Juris Doctor (JD) degree from an accredited law school.
  • Member in good standing with the Georgia Bar.
  • Strong understanding of bankruptcy law, including Chapters 7, 11, and 13.
  • Excellent research, writing, and oral communication skills (writing sample required).
  • Ability to work independently and as part of a team.
  • Strong negotiation and litigation skills.
  • High attention to detail and strong organizational abilities.

Education and Certifications:

  • Juris Doctor (JD) degree from an accredited law school.
  • Admission to the Georgia Bar and in good standing.
