A law firm in Birmingham is seeking a Litigation Associate Attorney with 3+ years of experience practicing law, preferably with a focus on finance, real estate, or representation of financial institutions in real estate-related matters. The candidate will be responsible for handling a litigation caseload encompassing various property law matters, including foreclosure, bankruptcy, title disputes, and eviction matters. They will manage cases from referral through disposition, attend court hearings, perform discovery, and provide legal advice to clients.

 

Duties:

  • Handle litigation caseload involving probate, title curative, wrongful foreclosure, title disputes, eviction matters, tax issues, etc.
  • Manage cases from referral through disposition, settlement, or verdict.
  • Attend court hearings and perform discovery.
  • Respond to disputes, adhere to investor guidelines, and comply with state and federal requirements.
  • Prepare and review documents for accuracy, including court filings, correspondence, and figures for demand letters.
  • Resolve title issues and complete necessary curative actions for clear title.
  • Provide legal advice to clients and conduct legal research on applicable statutes and case law.

 

Requirements:

  • Juris Doctor (J.D.) degree from an accredited law school.
  • Licensed to practice law and in good standing in Alabama, with licensure in additional states preferred.
  • Familiarity with rules of evidence and experience in foreclosure law, bankruptcy, litigation, and property law.
  • Knowledge of state laws and civil procedure, with familiarity with federal court practice being a plus.
  • 3+ years of experience practicing law, with courtroom experience preferred.
  • Experience in real estate, mortgage, or commercial litigation strongly preferred.
  • Knowledge of FDCPA, RESPA, TILA, and applicable state and federal debt collection and real property law a plus.
  • Exceptional communication skills (oral and written).
  • Proficiency in legal research, writing, and document drafting.
