Duties

  • Assist clients in establishing and managing guardianships and conservatorships for minors and incapacitated adults.
  • Prepare and file necessary legal documents, including petitions, reports, and accounting for judicial approval.
  • Advise clients on their fiduciary duties, guardianship responsibilities, and compliance with relevant statutes.
  • Provide counsel on alternatives to guardianship, such as powers of attorney and trusts.
  • Aid in planning for incapacity and special needs care for clients.
  • Design and implement guardianship plans, addressing financial management, healthcare decisions, and living arrangements.
  • Represent clients in contested guardianship cases, resolving disputes regarding capacity, the suitability of guardians, and fiduciary obligations.
  • Negotiate settlements and work to resolve conflicts through mediation and arbitration.
  • Draft and review legal documents such as petitions, orders, annual reports, and care plans.
  • Prepare legal correspondence, motions, and settlement agreements, ensuring attention to detail and accuracy in all legal documents.

Requirements

  • 1-5 years of experience in guardianship and conservatorship law.
  • Strong understanding of legal principles related to fiduciary duties and statutory compliance.
  • Proven ability to represent clients in contested legal matters, including litigation and dispute resolution.
  • Experience in drafting and reviewing legal documents, such as petitions, motions, and settlement agreements.
  • Ability to manage multiple cases and deadlines effectively.
  • Strong interpersonal skills and the ability to work closely with clients, their families, and other professionals.

Education

  • Juris Doctor (JD) degree from an accredited law school.

Certifications

  • Active member of the Nevada State Bar, or eligibility to waive into the Nevada State Bar.
