Mid-Senior Level Patent Litigation Associate Attorney

A law firm in San Francisco, CA, is seeking a Mid-Senior Level Patent Litigation Associate Attorney to join their team. This role involves working closely with clients to navigate patent disputes and intellectual property challenges. The ideal candidate will have substantial experience in patent litigation, including trial experience, and will be adept at managing complex litigation matters while providing strategic solutions.

Duties:

• Collaborate with clients to address patent-related obstacles and stay ahead of evolving patent laws and judicial decisions.
• Develop strategies to navigate competitors’ patents and protect clients' intellectual property assets.
• Draft pleadings, motions, memoranda, and correspondence for use in state and federal courts, arbitration, and mediation proceedings.
• Draft and respond to complex discovery requests and manage discovery processes.
• Communicate, negotiate, and confer with opposing counsel on litigation matters.
• Prepare for and conduct depositions, including preparing witnesses and managing trial preparations.
• Prepare for trial, including creating exhibit lists, formulating evidentiary objections, and drafting motions in limine.
• Prepare briefs for Federal Circuit appeals and support appellate litigation.
• Supervise and train junior associates, providing guidance and oversight on casework.

Requirements:

• 6-8 years of patent litigation experience, including expertise in drafting and responding to pleadings, preparing infringement and invalidity claim charts, and managing Markman and claim construction proceedings.
• Experience with patent-specific fact and expert discovery, inter-part reviews, and overall litigation strategy.
• Strong academic credentials, superb judgment, and excellent communication skills.
• Experience in patent trials is a plus.
• USPTO admission is highly desired.
• An undergraduate degree in Electrical Engineering or Computer Science, or substantial experience litigating in these or similar disciplines, is highly preferred.

Education:

• Juris Doctor (JD) from an accredited law school.
• Undergraduate degree in Electrical Engineering, Computer Science, or a related field is highly preferred.

Certifications:

• Admission to the USPTO is highly desired.

Skills:

• Extensive experience in patent litigation and managing complex cases.
• Proficiency in drafting legal documents and managing discovery.
• Strong negotiation and communication skills.
• Excellent judgment and strategic thinking.
• Ability to supervise and mentor junior associates.
• Familiarity with patent trial procedures and Federal Circuit appeal briefs.
