Job Overview:

A law firm is seeking a Workers' Compensation Defense Attorney to join its team in defending employers, insurance companies, third-party administrators, and employer representatives. The attorney will handle all aspects of workers' compensation claims litigation, including discovery, depositions, trials, arbitrations, and settlement negotiations. The ideal candidate will also be responsible for case evaluation, strategy development, and ensuring that all procedural requirements are met efficiently.

Key Responsibilities:

  • Handle all aspects of workers' compensation litigation, including discovery, depositions, trials, arbitrations, and settlement negotiations.
  • Conduct case evaluation and preparation, including thorough legal research and analysis of each case.
  • File pleadings in response to applicants' claims and draft various legal documents such as briefs and correspondences.
  • Prepare for and attend hearings, depositions, and WCAB (Workers' Compensation Appeals Board) appearances.
  • Develop case strategy, recommend courses of action, and manage legal proceedings from start to resolution.
  • Write legal briefs, pleadings, and other relevant documents to defend against workers' compensation claims.
  • Correspond with clients, providing regular status updates on cases and advising on litigation strategies.
  • Negotiate settlements on behalf of clients, ensuring favorable resolutions within legal and ethical boundaries.
  • Perform administrative tasks related to the management and handling of cases.
  • Maintain organized case files and ensure all deadlines and procedural requirements are met.
  • Collaborate with clients and internal teams to ensure timely and effective resolution of claims.

Education and Certifications:

  • Juris Doctor (JD) degree from an accredited law school.
  • Must be in good standing with the California Bar Association.

Experience Requirements:

  • Minimum of 2 years of experience in workers' compensation defense litigation.
  • Experience handling all stages of litigation, from discovery to trial/arbitration and settlement negotiations.

Skills and Knowledge Requirements:

  • Strong knowledge of California workers' compensation law and procedures.
  • Ability to identify and analyze legal issues in related areas of law.
  • Strong litigation skills, including case management, legal writing, and oral advocacy.
  • Exceptional interpersonal and communication skills.
  • Technologically adept, with the ability to use legal software and research tools.
  • Excellent organizational and time-management skills, with the ability to manage a heavy caseload efficiently.
  • Demonstrated good judgment and decision-making skills in litigation settings.
