A law firm in Dallas is seeking an experienced ERISA Attorney with deep expertise in employee benefits and retirement plans. The ideal candidate will have a strong understanding of ERISA and Tax Code regulations, particularly focusing on qualified and non-qualified pension plans, group health plans, and welfare benefit plans. Experience advising on fiduciary compliance and handling IRS and DOL audits is highly desired.

Duties and Responsibilities:

  • Provide legal counsel and strategic advice to clients on ERISA compliance issues and employee benefit plans.
  • Draft, review, and amend plan documents for various retirement plans, including 401(k), 403(b), and 457(b) plans.
  • Advise on arrangements subject to 409A, 457(f), and top-hat plans.
  • Ensure compliance with federal regulations governing group health plans, including ACA, COBRA, HIPAA, HITECH, and GINA.
  • Assist clients with welfare benefit plans such as cafeteria plans, wellness programs, health FSAs, HSAs, dependent care arrangements, and disability and life insurance plans.
  • Represent plan sponsors in IRS and DOL correction programs and audits, providing strategic guidance throughout the process.
  • Stay updated on legal developments and regulatory changes impacting ERISA and employee benefits law.

Requirements:

  • Juris Doctor (JD) degree from an accredited law school.
  • Admission to the State Bar of Texas (or eligibility for admission by motion).
  • 4+ years of experience practicing ERISA law, ideally at a law firm or corporate legal department.
  • In-depth knowledge of ERISA, Tax Code regulations, and related federal laws.
  • Strong analytical skills and the ability to interpret complex legal documents and regulations.
  • Excellent written and verbal communication skills, with the ability to communicate effectively with clients and regulatory agencies.

Preferred Certifications:

  • Certification in Employee Benefits Law (CEBS) or Certified Pension Consultant (CPC) designation is a plus.
