A law firm in Charlotte, NC, is seeking a highly skilled Workers' Compensation Attorney to represent injured plaintiff-employees in their workers’ compensation cases. The ideal candidate will have extensive experience handling complex workers’ compensation claims and will provide comprehensive legal advice and representation at all stages of the case. This role involves managing a team of case managers and paralegals, drafting legal documents, negotiating settlements, and litigating cases before various levels of the NC Industrial Commission and Court of Appeals.

Key Responsibilities:

  • Represent injured plaintiff-employees in their North Carolina workers’ compensation cases.
  • Provide legal advice and representation during all stages of workers’ compensation cases, including pre- and post-litigation, discovery, and settlement negotiation.
  • Assist clients in obtaining benefits under the NC Workers’ Compensation Act.
  • Litigate workers’ compensation cases at the Deputy Commissioner, Full Commission, and Court of Appeals levels.
  • Draft pleadings, discovery documents, orders, and motions.
  • Negotiate settlement agreements, releases, and job resignations on behalf of clients.
  • Draft briefs for presentation at the Deputy Commissioner and Full Commission levels of the NC Industrial Commission and at the NC Court of Appeals.
  • Oversee and manage Workers’ Compensation Case Managers and Paralegals.
  • Maintain and manage a high caseload while ensuring thorough case preparation and effective client representation.

Requirements:

  • Juris Doctorate (JD) from an accredited law school.
  • License to practice law in North Carolina.
  • Minimum of 5 years of legal experience in a workers’ compensation law firm and/or insurance defense firm; plaintiff’s side experience is preferred.
  • Experience working on complex workers’ compensation claims.
  • Ability to work effectively in a fast-paced, demanding environment.
  • Exceptional analytical, writing, and verbal communication skills.
  • Outstanding interpersonal skills and self-motivation to complete duties with minimal supervision.
  • Excellent organizational skills and ability to multi-task while maintaining high attention to detail.
  • Extensive knowledge of medical issues in contested and accepted workers’ compensation claims, and familiarity with the hearing process.
  • Proficiency in Microsoft Windows/Office and ability to learn and use various software programs.
  • Experience with Litify software is preferred.

Education:

  • Juris Doctorate (JD) from an accredited law school.

Certifications:

  • License to practice law in North Carolina.

Skills:

  • Strong litigation skills and in-depth knowledge of workers’ compensation law.
  • Proficiency in drafting legal documents and briefs.
  • Effective negotiation skills for settlement agreements.
  • Ability to manage a team of case managers and paralegals.
