Duties and Responsibilities

  • Client Counseling

    • Advise clients on state and federal privacy laws, including product development, governance programs, and compliance.
    • Provide strategic guidance on M&A, financing, and commercial transactions.
  • Litigation and Regulatory Defense

    • Handle class action litigation, regulatory defense, and incident response.
    • Represent clients in data breach investigations, ransom negotiations, and enforcement actions.
    • Lead or assist in trial preparations and proceedings related to privacy, cybersecurity, and AI matters.
  • Investigations and Incident Response

    • Direct investigations into data breaches and cyberattacks, managing crisis response and regulatory defense.
    • Defend clients against enforcement actions brought by government regulators, including the FTC, SEC, and EU regulators.
  • Cross-Border Legal Counsel

    • Advise clients on compliance with global regulatory frameworks such as the GDPR, ePrivacy Directive, and data transfer regulations.
    • Support clients in international legal matters involving AI/ML and biometric technologies.
  • Collaboration and Teamwork

    • Work closely with senior attorneys to develop case strategies and legal arguments.
    • Participate in firm-wide knowledge sharing and mentoring initiatives.

Requirements

  • Experience

    • 4-7 years of experience in privacy law, cybersecurity, and AI, with a focus on litigation, regulatory defense, and incident response.
    • Strong experience in advising clients on state and federal privacy laws, including GDPR, CCPA/CPRA, HIPAA, and more.
    • Previous experience in handling data breach response and defending enforcement actions.
  • Skills

    • Excellent verbal and written communication skills, with the ability to articulate complex legal concepts clearly.
    • Strong negotiation and litigation skills, with experience in high-stakes cases.
    • Familiarity with data-driven technologies, including AI/ML and biometrics, and related global regulatory frameworks.
  • Certifications

    • Active license to practice law in at least one U.S. jurisdiction.
    • Additional certifications in privacy law (e.g., CIPP/US, CIPP/E) are a plus.

Education

  • Juris Doctor (J.D.) degree from an accredited law school.
