Job Overview:
A leading law firm is seeking a Partner level attorney with expertise in health and welfare employee benefits to join its Employee Benefits & Executive Compensation practice. The ideal candidate will provide comprehensive legal advice on various aspects of health and welfare benefit plans, including compliance with key laws such as the Affordable Care Act, COBRA, and HIPAA. This role involves drafting and negotiating service provider agreements and offering proactive counsel on compliance and litigation issues affecting employee benefit plans.

Location:

  • Atlanta, GA

Duties:

  • Provide legal counsel on health and welfare benefit plans, including wrap plans, cafeteria plans, and flexible benefits arrangements
  • Advise clients on compliance with Affordable Care Act (ACA), COBRA, HIPAA, Mental Health Parity and Addiction Equity Act, and other relevant laws
  • Draft and negotiate service provider agreements
  • Counsel clients on compliance with TiC (Transparency in Coverage) and CAA 21 (Consolidated Appropriations Act 2021)
  • Resolve legal and administrative issues related to health and welfare plan administration
  • Provide proactive advice on compliance and litigation issues affecting health and welfare benefit plans

Requirements:

  • Extensive experience advising on health and welfare employee benefit plans
  • Expertise in ACA, COBRA, HIPAA, and other key regulatory frameworks
  • Proven ability to draft and negotiate service provider agreements
  • Experience providing proactive legal advice on compliance and litigation matters
  • Strong client advisory and relationship management skills

Education:

  • Juris Doctor (JD) from an accredited law school

Certifications:

  • Licensed to practice law in at least one U.S. jurisdiction

Skills:

  • In-depth knowledge of employee benefits and executive compensation regulations
  • Excellent drafting, negotiation, and communication skills
  • Strong analytical and problem-solving abilities
  • Ability to manage complex legal matters and client relationships
  • Ability to work both independently and collaboratively
