Job Overview:

A law firm seeks an experienced Employee Benefits & Executive Compensation Attorney to join its Virginia Beach office. This role involves designing and managing complex employee benefits programs, including retirement, health and welfare, and executive compensation plans. The attorney will also provide strategic advice on compliance with IRS and other regulatory requirements, ensuring clients' benefit programs meet legal standards. This is an opportunity to lead the firm's Employee Benefits & Executive Compensation practice while working with a diverse client base across industries.

Duties:

  • Design, implement, and maintain employee benefits programs, including retirement, health, welfare, and executive compensation plans.
  • Analyze and ensure compliance with Code Sections 409A, 457(f), 280G, and 162(m).
  • Negotiate with regulatory agencies such as the IRS, DOL, and PBGC to secure favorable outcomes for clients.
  • Advise clients on ERISA matters, including issues related to mergers, acquisitions, pension plans, and collective bargaining agreements.
  • Guide the Affordable Care Act, HIPAA, HITECH, and wellness programs.
  • Counsel a diverse range of clients, including for-profit, tax-exempt entities, large health systems, and governmental bodies.
  • Lead the firm's Employee Benefits and Executive Compensation practice, contributing to policy and recruitment efforts.

Requirements:

  • Licensed to practice law in Virginia.
  • Extensive experience in employee benefits and executive compensation law.
  • Strong knowledge of Code Sections 409A, 457(f), 280G, and 162(m).
  • Proven ability to negotiate with regulatory agencies, including the IRS, DOL, and PBGC.
  • Deep understanding of ERISA, the Affordable Care Act, HIPAA, and HITECH regulations.
  • Experience advising a diverse client base.
  • Leadership experience with the ability to collaborate effectively within a team.

Education:

  • Juris Doctor (J.D.) from an accredited law school.

Certifications:

  • Active Virginia Bar admission is required.
