Job Overview:
A prestigious law firm is seeking a mid-level Finance & Bankruptcy Associate Attorney to join its team in New York. This position offers the opportunity to work on complex U.S. and cross-border bankruptcy cases. The ideal candidate will have a background in representing debtors, creditor's committees, lenders, and investors, and will be responsible for drafting legal documents, managing bankruptcy-related litigation, and providing advice in bankruptcy proceedings. Location:

Duties:

  • Represent debtors, creditor’s committees, lenders, and debt and equity investors in bankruptcy matters.
  • Draft bankruptcy petitions, first-day pleadings, bankruptcy motion practice, disclosure statements, and plans.
  • Handle bankruptcy-related litigation, including prosecuting and defending preference and fraudulent conveyance actions, foreclosures, and contested plans.
  • Represent DIP lenders and borrowers in bankruptcy cases.
  • Advise clients in connection with Section 363 sales, including representing sellers, stalking horse bidders, and competing bidders.
  • Prosecute and defend breach of fiduciary duty claims against insolvent companies.
  • Provide advice to clients preparing to file Chapter 11 bankruptcy cases.
  • Collaborate with internal teams, including commercial finance, real estate, corporate, tax, labor, and securities attorneys, on cross-disciplinary insolvency matters.

Requirements:

  • 3-5 years of experience in finance and bankruptcy law, including experience representing debtors, creditor’s committees, lenders, and investors.
  • Experience drafting bankruptcy petitions, first-day pleadings, disclosure statements, plans, and handling bankruptcy motions.
  • Experience in bankruptcy litigation, including preference and fraudulent conveyance actions and contested plans.
  • Strong background in handling Section 363 sales, breach of fiduciary duty claims, and advising clients in Chapter 11 cases.
  • Clerkship experience with a bankruptcy judge is a plus.
  • Ability to manage multiple and varied projects simultaneously and efficiently.
  • Excellent interpersonal, analytical, oral communication, and writing skills.
  • Understanding of business accounting issues as related to bankruptcy and restructuring matters.

Education:

  • Juris Doctor (JD) degree from an accredited law school.
  • Impressive academic credentials required.

Certifications:

  • Must be admitted to the New York State Bar.

Skills:

  • Strong expertise in finance and bankruptcy law, particularly in corporate restructuring and creditor’s rights.
  • Proficient in drafting and filing bankruptcy documents and handling related motions.
  • Strong litigation experience in bankruptcy-related matters.
  • Excellent communication and negotiation skills.
  • Ability to work efficiently both independently and as part of a team in a fast-paced environment.
