Mid-Senior Level Patent Litigation Associate Attorney

A law firm in Albany, NY, is seeking a Mid-Senior Level Patent Litigation Associate Attorney with 6-8 years of experience. The successful candidate will manage complex patent litigation matters, work closely with clients to navigate patent laws, and develop strategies to protect and leverage intellectual property. Ideal candidates will have significant experience in patent litigation, including drafting pleadings and preparing for trials, as well as experience or a degree in Electrical Engineering or Computer Science.

Duties and Responsibilities:

• Work directly with clients to address obstacles, stay ahead of changes in patent laws, and adapt to judicial decisions.
• Develop and implement strategies to navigate competitors’ patents and extract value from intellectual property.
• Draft and respond to complex pleadings, motions, memoranda, and correspondence for state and federal court, arbitration, and mediation.
• Handle complex discovery tasks, including drafting and responding to discovery requests.
• Engage in conferring, negotiating, and communicating with opposing counsel.
• Prepare for, defend, and conduct depositions.
• Manage trial preparation, including preparing exhibit lists, evidentiary objections, motions in limine, and witness preparation.
• Prepare Federal Circuit appeal briefs.
• Supervise and train junior associates to foster their development and ensure quality work.
• Provide solutions and strategic advice on patent infringement and validity issues, Markman and claim construction proceedings, and inter partes reviews.

Requirements:

• Juris Doctorate (JD) from an accredited law school.
• Admission to practice law in New York.
• 6-8 years of experience in patent litigation, including significant experience with:
  • Drafting and responding to pleadings.
  • Preparing infringement and invalidity claim charts.
  • Markman and claim construction proceedings.
  • Patent-specific fact and expert discovery.
  • Inter partes reviews and overall litigation strategy.
• Experience or a degree in Electrical Engineering or Computer Science, or substantial experience in litigating similar matters, is highly desired.
• Patent trial experience is a plus.
• USPTO admission is highly desired.

Education:

• Juris Doctorate (JD) required.
• Undergraduate degree in Electrical Engineering or Computer Science is preferred.

Certifications:

• Licensed to practice law in New York.
• USPTO admission is highly desired.
