Mid-Senior Level Patent Litigation Associate Attorney

Job Overview:

A law firm in Rochester, NY, seeks a mid-senior-level Patent Litigation Associate Attorney to join its team. The successful candidate will handle complex patent litigation cases, working closely with senior attorneys and clients to provide exceptional legal services. This role requires extensive experience in patent litigation, excellent legal understanding, and the ability to manage cases from inception through appeal.

Key Responsibilities:

• Draft pleadings, motions, memoranda, and correspondence for state and federal court, arbitration, and mediation proceedings.
• Draft and respond to complex discovery requests, including interrogatories, requests for production, and requests for admission.
• Confer, negotiate, and communicate with opposing counsel to discuss case strategy and settlement options.
• Prepare for, defend, and conduct depositions of fact witnesses, expert witnesses, and corporate representatives.
• Assist in trial preparation, including preparing exhibit lists, evidentiary objections, motions in limine, and witness preparation.
• Draft and prepare Federal Circuit appeal briefs and other appellate court filings.
• Supervise and train junior associates, guiding legal research, writing, and litigation strategies.
• Engage in Markman hearings, claim construction proceedings, and inter partes reviews.
• Develop and implement overall litigation strategy, coordinating with clients and internal teams to ensure alignment with client goals.

Requirements:

• 6-8 years of patent litigation experience, including substantial experience with drafting and responding to pleadings, preparing infringement and invalidity claim charts, and engaging in patent-specific fact and expert discovery.
• Significant experience with Markman and claim construction proceedings.
• Experience with inter partes reviews and overall litigation strategy.
• Patent trial experience is a plus.

Education & Certifications:

• Juris Doctor (J.D.) degree from an accredited law school.
• Admission to the USPTO (United States Patent and Trademark Office).
• An undergraduate degree in Electrical Engineering or Computer Science or substantial experience litigating matters in these or similar disciplines is highly desired.
• Admission to the New York State Bar or eligibility for admission on motion.
