A law firm in San Jose, CA is seeking an experienced Traditional Labor Of Counsel to join their team. This role is designed for a seasoned attorney who will primarily represent employers in traditional labor matters while also providing advice and counsel on federal and California workplace laws. The position involves a range of responsibilities including handling unfair labor practice charges, managing NLRB elections, and negotiating collective bargaining agreements. The ideal candidate will have extensive experience in labor law and a thorough understanding of both federal and California employment regulations.

Key Responsibilities:

  • Represent employers in traditional labor matters, including handling unfair labor practice charges before the National Labor Relations Board (NLRB).
  • Provide legal advice on federal and California workplace laws, including union organizing, corporate campaigns, card check, and neutrality agreements.
  • Advise and negotiate collective bargaining agreements and handle grievance, arbitration, and unfair labor practice proceedings.
  • Obtain mass picketing injunctions and provide counsel on federal and California wage and hour issues, leave management, and disability accommodations.
  • Review and ensure compliance of employer handbooks, policies, forms, compensation plans, commission, and bonus plans with federal and state laws.
  • Conduct due diligence on employer operations related to workplace law issues in the context of mergers and acquisitions.
  • Provide management training on labor relations, workplace issues, harassment, discrimination, and retaliation.
  • Perform legal research and writing as needed, and handle other assignments as reasonably assigned.

Qualifications:

  • Juris Doctor (JD) degree from an ABA-accredited law school.
  • Minimum of 9 years of experience in litigation or advice work as an attorney, with a strong background in traditional labor law.
  • Preferred experience in federal and/or California advice and counsel work.
  • Active California Bar admission is required.
  • Understanding of current state and federal agency enforcement techniques is preferred.
  • Bilingual in English and Spanish is preferred.
