A law firm seeks a skilled Labor and Employment Attorney to join its team in Charlottesville, VA. This attorney will specialize in handling a wide range of employment-related legal matters, including workplace disputes, employee rights, labor union issues, and employer obligations. The role involves providing legal counsel to both employers and employees on topics such as discrimination, harassment, wage disputes, wrongful termination, collective bargaining, and compliance with labor laws and regulations.

Duties

  • Client Counseling

    • Provide legal advice on various labor and employment matters, including workplace disputes, wage and hour issues, discrimination, harassment, wrongful termination, and other employment-related issues.
    • Guide clients through compliance with federal, state, and local labor laws, such as the Fair Labor Standards Act (FLSA), Family and Medical Leave Act (FMLA), Title VII, and the National Labor Relations Act (NLRA).
    • Review and draft employment-related documents, such as contracts, non-compete agreements, employee handbooks, and workplace policies.
  • Litigation and Dispute Resolution

    • Represent clients in litigation, including before federal and state courts, administrative agencies (EEOC, Department of Labor), and in alternative dispute resolution processes (arbitration and mediation).
    • Handle employment-related lawsuits, including claims of wrongful termination, wage violations, discrimination, harassment, and other labor law breaches.
    • Represent employers or labor unions in collective bargaining, draft union contracts, manage labor disputes, and advise on grievance procedures.
  • Workplace Investigations

    • Conduct thorough investigations into workplace complaints, including allegations of discrimination, harassment, retaliation, and other employment-related issues.
  • Training and Education

    • Deliver training to employers and employees on key topics such as sexual harassment prevention, workplace safety, employee rights, and discrimination.
    • Prepare legal documents, including pleadings, motions, discovery requests, and settlement agreements.

Requirements

  • Juris Doctor (JD) degree from an accredited law school.
  • Admission to the Virginia State Bar.
  • At least 3 years of experience in labor and employment law, including both advisory and litigation experience.
  • In-depth knowledge of federal and state labor and employment laws, including FLSA, FMLA, ADA, Title VII, and NLRA.
  • Familiarity with workplace compliance and employee relations matters.
  • Strong litigation experience and proficiency in alternative dispute resolution methods (arbitration and mediation).
  • Knowledge of collective bargaining and union-related matters is a plus.
  • Excellent legal research, analytical, and problem-solving skills.
  • Effective written and oral communication skills, with the ability to explain complex legal concepts clearly.
  • Strong negotiation and advocacy skills.
  • Ability to manage multiple cases and competing priorities effectively.

Education

  • Juris Doctor (JD) from an accredited law school.

Certifications

  • Admission to the Virginia State Bar.
