Job Overview:

A law firm in Durham, NC, is seeking an experienced Construction Attorney to join their team. The ideal candidate will have a robust construction law background, including drafting and negotiating contracts, litigating construction claims, and providing comprehensive regulatory compliance advice. This role requires an individual with a proven track record in handling complex construction-related legal issues and working closely with clients throughout the construction process.

Key Responsibilities:

  • Draft, review, and negotiate construction and design contracts to ensure alignment with client interests and legal standards.
  • Represent clients in construction-related disputes, including litigation of construction defects, delay claims, cost overruns, bid protests, subcontractor disputes, and product liability.
  • Advise clients on regulatory compliance and manage legal aspects throughout the entire course of construction projects.
  • Handle matters related to bonds, sureties, mechanic’s liens, agreements with financial institutions, stop notices, and public contract law.
  • Provide legal counsel on prompt payment laws and their implications for construction projects.
  • Prepare and present cases before relevant authorities, including the Construction Board, if necessary.
  • Stay updated on changes in construction law and best practices to provide current and practical legal advice.

Requirements:

  • Minimum of 5 years of experience in construction law.
  • Demonstrated experience in drafting and negotiating construction and design contracts.
  • Proven track record in litigating construction-related claims and disputes.
  • In-depth knowledge of bonds, sureties, mechanic’s liens, public contract law, and prompt payment laws.
  • Expertise in regulatory compliance and advising clients throughout construction projects.
  • Experience with AIA forms and LEED certification is preferred.
  • Experience defending matters before the Construction Board is a plus.

Education:

  • Juris Doctor (JD) degree from an accredited law school.
  • Licensed to practice law in the state of North Carolina.

Certifications:

  • Membership in the North Carolina State Bar.
  • Additional certifications related to construction law are advantageous.

Skills:

  • Strong analytical and problem-solving skills.
  • Excellent verbal and written communication abilities.
  • Proven negotiation skills with the ability to manage complex legal agreements.
  • Detail-oriented with the capability to handle multiple tasks and deadlines efficiently.
