Job Title: Senior Advertising, Marketing, and Promotions Attorney
Location: Palo Alto, CA

Job Overview:
A law firm is seeking an experienced Senior Advertising, Marketing, and Promotions Attorney to join their Palo Alto office. The ideal candidate will have extensive experience in advertising law, consumer protection law, and marketing transactions. This role involves providing legal counsel on various aspects of advertising, including contract negotiation, compliance, and dispute resolution. The successful candidate will be an expert in false advertising, unfair competition, and marketing law, with a solid attention to detail and the ability to work collaboratively.

Key Responsibilities:

  • Contract Negotiation and Drafting:

    • Draft and negotiate advertising agency agreements, influencer and celebrity endorsement contracts, sponsorship deals, online media buying agreements, and other marketing and promotion contracts.
    • Provide legal support in creating and managing loyalty and rewards programs.
  • Advertising Compliance:

    • Review advertising copy for compliance with false advertising laws, intellectual property rights, and the right to publicity.
    • Counsel clients on claim substantiation and compliance with FTC guidelines and other regulatory requirements.
  • Promotional Activities:

    • Advise on the legal aspects of contests, sweepstakes, and other promotional activities, ensuring compliance with state and federal regulations.
    • Counsel on the legal implications of price advertising and recurring subscription programs.
  • Dispute Resolution:

    • Represent clients in disputes related to false advertising and unfair competition.
    • Handle matters before the National Advertising Division (NAD) and other relevant regulatory bodies.
  • Client Counseling:

    • Provide ongoing legal counsel to clients in the advertising, marketing, and promotions industries.
    • Stay updated on emerging trends in advertising law and communicate these developments to clients.

Requirements:

  • Experience:

    • Substantive experience in advertising law, consumer protection law, and marketing transactions.
    • Experience with false advertising, unfair competition, and National Advertising Division (NAD) dispute work is preferred.
    • Previous experience in a large or medium-sized law firm is highly desirable.
  • Education:

    • Juris Doctor (JD) degree from an accredited law school.
    • Admission to the California State Bar or ability to become a member promptly.
  • Skills:

    • Strong legal writing and communication skills.
    • Excellent attention to detail and the ability to manage multiple projects simultaneously.
    • Ability to work well in a collaborative team environment.
  • Certifications:

    • Member of the California State Bar.
    • Additional certifications in advertising or marketing law are a plus.
