A law firm in Madison, WI, seeks a highly skilled Senior Advertising, Marketing, and Promotions Attorney. The ideal candidate will possess extensive experience in advertising law, consumer protection law, and marketing transactions. This role involves a range of responsibilities, from drafting and negotiating complex agreements to providing counsel on compliance and legal issues related to advertising and promotions. The candidate should demonstrate exceptional attention to detail, strong teamwork, and outstanding legal writing and communication skills.

Duties and Responsibilities

• Draft, review, and negotiate agreements related to advertising, including ad agency contracts, influencer partnerships, celebrity endorsements, sponsorships, and online media buying.
• Review advertising copy to ensure compliance with laws and regulations concerning false advertising, claim substantiation, intellectual property, and right of publicity.
• Provide legal counsel on contest and sweepstakes compliance, price advertising, recurring subscriptions, and loyalty/rewards programs.
• Advise clients on false advertising, unfair competition, and National Advertising Division disputes.
• Collaborate with clients and internal teams to develop marketing strategies and address legal concerns.
• Stay updated on developments in advertising law and industry trends to provide proactive legal advice.
• Prepare and present legal opinions, memoranda, and reports.

Requirements

• Juris Doctor (JD) degree from an accredited law school.
• Active Bar admission in the state of Wisconsin.
• Substantive experience in advertising law, consumer protection law, and marketing transactions.
• Proven track record of drafting and negotiating complex advertising and marketing agreements.
• Experience handling false advertising, unfair competition, and National Advertising Division disputes is highly desirable.
• Previous experience in a large or medium law firm setting preferred.
