A law firm in Melville, NY, is seeking a Mid-Senior Level Patent Litigation Associate Attorney to join their team. This role involves working closely with clients to navigate patent disputes, stay abreast of evolving patent laws, and develop strategic solutions for intellectual property issues. The ideal candidate will have substantial patent litigation experience and be adept at managing complex litigation tasks and client relationships.

Duties:

  • Collaborate with clients to identify and address patent-related obstacles and adapt strategies to evolving patent laws and judicial decisions.
  • Develop and implement strategies to navigate competitors’ patents and enhance the value of clients’ intellectual property.
  • Draft and file pleadings, motions, memoranda, and correspondence for state and federal court proceedings, arbitration, and mediation.
  • Manage complex discovery processes, including drafting and responding to discovery requests.
  • Communicate and negotiate with opposing counsel to resolve litigation matters effectively.
  • Prepare for, defend, and conduct depositions, including managing witness preparation and deposition logistics.
  • Prepare for trial, including creating exhibit lists, formulating evidentiary objections, drafting motions in limine, and handling trial preparations.
  • Prepare and file briefs for Federal Circuit appeals and support appellate litigation.
  • Supervise and mentor junior associates, providing guidance and oversight on litigation tasks and professional development.

Requirements:

  • 6-8 years of patent litigation experience, including significant expertise in drafting and responding to pleadings, preparing infringement and invalidity claim charts, and managing Markman and claim construction proceedings.
  • Extensive experience with patent-specific fact and expert discovery, inter partes reviews, and overall litigation strategy.
  • Strong academic credentials and a commitment to providing excellent client service.
  • Patent trial experience is a plus.
  • USPTO admission and an undergraduate degree in Electrical Engineering, Computer Science, or substantial experience litigating in these or similar technical disciplines are highly desired.

Education:

  • Juris Doctor (JD) from an accredited law school.
  • Undergraduate degree in Electrical Engineering, Computer Science, or a related technical field is highly preferred.

Certifications:

  • Admission to the USPTO is highly desired.

Skills:

  • Expertise in patent litigation and managing complex cases.
  • Proficiency in drafting legal documents and handling discovery processes.
  • Excellent negotiation, communication, and client relationship skills.
