Job Overview:

A law firm in Phoenix, AZ, is seeking a highly qualified Senior Advertising, Marketing, and Promotions Associate Attorney. The ideal candidate will bring extensive experience in advertising law, consumer protection law, and marketing transactions. The role demands a high level of expertise in drafting and negotiating various marketing-related agreements and providing comprehensive legal counsel on advertising and promotional matters.

Duties:

• Draft and negotiate ad agency, influencer, celebrity endorsement, sponsorship, and online media buying agreements.
• Review and analyze ad copy for compliance with false advertising laws, claim substantiation, intellectual property rights, and right of publicity issues.
• Provide legal advice on contest and sweepstakes compliance, including prize promotions and rules.
• Counsel clients on price advertising, recurring subscriptions, and loyalty/rewards programs.
• Represent clients in disputes about false advertising, unfair competition, and National Advertising Division (NAD) matters.
• Collaborate with internal teams and clients to ensure alignment on marketing and promotional strategies.
• Stay current on developments in advertising law and regulatory changes that may impact clients’ marketing activities.

Requirements:

• Minimum of 7 years of relevant experience in advertising law, consumer protection law, and marketing transactions.
• Substantive experience in drafting and negotiating complex marketing and promotion agreements.
• Proven track record in advising on advertising compliance and handling disputes related to false advertising and unfair competition.
• Strong attention to detail and excellent organizational skills.
• Ability to work effectively in a collaborative team environment.

Education:

• Juris Doctor (JD) degree from an accredited law school.
• Excellent academic credentials.

Certifications:

• Admission to the Bar in the state of Arizona.

Skills:

• Outstanding legal writing and communication skills.
• Expertise in false advertising, claim substantiation, and intellectual property issues.
• Proficiency in handling marketing-related legal issues, including compliance with contest and sweepstakes regulations.
• Experience in a large or medium-sized law firm setting is preferred.
