Job Overview: An established immigration law firm in Powell, Ohio, is seeking an experienced Senior Appeals and RFE Attorney to lead a team responsible for managing immigration appeals and responses to Requests for Evidence (RFE) and Notices of Intent to Deny (NOID). This role involves overseeing the appeals process, conducting in-depth legal research, and providing strategic guidance on immigration cases. Ideal candidates will have substantial experience in immigration law, particularly in handling RFEs, NOIDs, and appeals, with a strong commitment to advocating for clients in complex immigration matters.

Location:

  • Powell, Ohio

Duties:

  • Develop and establish processes for appealing USCIS decisions, including the filing of Form I-290B and pursuing federal litigation options
  • Analyze USCIS communications, such as RFEs, NOIDs, and application denials, to determine appropriate responses
  • Manage a team focused on appeals and RFE responses, ensuring deadlines are met and responses are continually improved
  • Provide training to non-attorney team members and address legal questions related to appeals and RFEs
  • Offer feedback to both legal and non-legal staff to enhance overall quality and performance
  • Review application materials and identify additional evidence required for USCIS submissions
  • Conduct legal and factual research to support appeals and RFE responses
  • Draft and edit legal documents, including cover letters, motions, and briefs

Requirements:

  • Minimum of five years of experience as an attorney, with at least one year specializing in immigration law
  • Experience in drafting responses to RFEs and NOIDs; familiarity with VAWA, T-Visa, U-Visa, Asylum, or Medical Deferred Action cases is advantageous
  • Proven ability to handle appeal briefs and federal litigation involving USCIS decisions
  • Experience managing a legal team and coordinating with non-attorney staff

Education:

  • Juris Doctor (JD) from an ABA-accredited law school

Certifications:

  • Active license to practice law in any U.S. state or territory

Skills:

  • Strong legal research and writing skills, with a keen attention to detail
  • Proficient in drafting immigration-related documents and legal briefs
  • Excellent organizational and communication skills
  • Bilingual proficiency in English and Spanish preferred
  • Experience in a state or federal clerkship is a plus
