Key Responsibilities

• Drafting & Negotiation:

  • Draft and negotiate agreements related to advertising, marketing, and promotions, including:
    • Ad agency agreements
    • Influencer and celebrity endorsement contracts
    • Sponsorship deals
    • Online media buying agreements
    • Marketing and promotion agreements
  • Manage negotiations with third parties to secure favorable terms for clients.

• Advertising Review:

  • Review advertising copy for potential legal issues, including:
    • False advertising claims
    • Claim substantiation
    • Intellectual property (IP) concerns
    • Right of publicity considerations

• Legal Counseling:

  • Provide counsel on compliance with legal regulations for contests and sweepstakes.
  • Advise on price advertising, including legal considerations for recurring subscription programs.
  • Offer guidance on the development and management of loyalty/rewards programs.

• Litigation & Dispute Resolution:

  • Handle false advertising and unfair competition disputes.
  • Represent clients in disputes before the National Advertising Division (NAD) of the Better Business Bureau.

• Collaboration & Teamwork:

  • Collaborate effectively with other attorneys, legal assistants, and clients.
  • Contribute to team meetings and discussions, bringing attention to critical details in legal matters.

Requirements

• Experience:

  • Substantive experience in advertising law, consumer protection law, and marketing transactions.
  • Experience in false advertising, unfair competition, and NAD dispute work.
  • Prior experience working in a large or medium law firm setting is preferred.

• Education:

  • Juris Doctor (JD) degree from an accredited law school.
  • Strong academic credentials are essential.

• Certifications:

  • Admission to the Bar in Washington or obtaining admission promptly.
